Some Facts About Date Rape

Sexual assault is a deeply traumatic experience, and when it happens in the context of a date or with a known acquaintance, the confusion and emotional pain can feel overwhelming.

It's crucial to understand that this form of assault, often referred to as 'date rape' or 'acquaintance rape,' is more prevalent than many people realize. By being aware of this, you are better equipped to recognize and respond to potential threats.

Unfortunately, it is also significantly under-reported. Many survivors feel shame, fear, or uncertainty about what happened, especially if the perpetrator was a friend, partner, or someone they trusted.

They may not even realize that what happened to them was rape--or that somehow it was their fault.

It's important to know that in California, any sexual penetration without your express consent is rape, even if it occurs on a date. This means you have the right to file a civil claim against your abuser to recover damages. Understanding your legal rights can empower you to take action.

What is Date Rape?

Date rape is a form of sexual assault where someone is pressured into a sexual act by someone they know. When someone is arrested for date rape, they may face various charges. Additionally, an individual could be charged with multiple crimes related to date rape.

Date rape differs from other types of sexual assault because the victim always knows their attacker. Whether it's a classmate, coworker, or neighbor, if the person is familiar to you, then the term date rape applies.

As noted, sometimes, this is also called acquaintance rape. Despite the terminology, the meaning remains unchanged.

Date Rape Drugs and Their Role in Sexual Assault

Sadly, some women fall victim to date rape when an acquaintance secretly drugs their food or drink, leading to unconsciousness or unresponsiveness. It's easy for a date to slip drugs into your beverage unnoticed, which can result in confusion or difficulty defending yourself later.

Sometimes, date rape drugs lead to memory loss, causing women to be unaware they've been attacked or to doubt if they consented, since they don't remember doing so.

This often makes women hesitant to report the assault. Some of the most frequently used date rape drugs include:

  • Alcohol
  • Ketamine
  • Sleeping pills
  • Tranquilizers
  • Antidepressants
  • Gamma-Hydroxybutyric Acid (GHB)
  • Rohypnol (Roofies)

Let's take a closer look at some facts about date rape you might not be aware of.

Date Rape Usually Involves Someone the Victim Knows

A common misconception about rape is that a stranger usually commits it in a dark alley. The reality is that most sexual assaults are perpetrated by someone the victim knows--and this is almost always the case in incidents of date rape.

In one survey, 84 percent of rape victims said their attacker was someone they knew. This familiarity can be a source of profound betrayal and confusion, making it difficult for survivors to label the experience as rape. You must remember that your relationship with a person never permits them to violate your boundaries.

Consent Is Required Every Single Time

Consent is a fundamental principle in any sexual activity. In California, it must be given freely and voluntarily. It cannot be assumed that a prior relationship implies consent for future acts.

Critically, a person who is incapacitated cannot legally give consent. This includes situations where someone is asleep, unconscious, or impaired by drugs or alcohol.

If you were intoxicated, drugged, or otherwise unable to give a clear and voluntary 'yes,' any sexual activity that occurred was non-consensual and is considered sexual assault. If penetration occurred, it was rape. Period. Understanding and asserting your right to consent is crucial in preventing and addressing date rape.

Alcohol and "Date Rape Drugs" Are Frequently Used 

Alcohol is the substance most commonly associated with date rape. Sometimes, it makes it more difficult to recognize. An assailant may encourage excessive drinking or take advantage of someone who is already intoxicated.

In other cases, perpetrators use drugs like Rohypnol, GHB, or Ketamine to sedate a victim. These substances can cause disorientation, loss of inhibition, and memory loss, making it easier for an assault to occur and harder for the survivor to recall the details afterward.

Some common signs that you may have been drugged and raped include:

  • Waking up with a gap in your memory after a date
  • Feeling far more intoxicated than expected for the amount of alcohol consumed
  • Feeling physically like you've had sex but not remembering it
  • Waking up with your clothes torn, disheveled, or removed, with no memory of how it happened
  • Waking up with unexplained bruises, cuts, or soreness

If your memory is cloudy and you are uncertain if you were raped, visit a physician and get an examination as soon as possible.

Most Survivors Do Not Report the Assault

Due to the complex emotional factors involved, date rape is one of the most under-reported crimes. According to the same survey mentioned above, only 5 percent of date rape victims reported the incident to the police, and 42 percent of survivors told no one at all.

Survivors may fear they won't be believed, especially if alcohol was involved or if the perpetrator is a well-regarded member of their social circle.

They may also blame themselves or feel ashamed, even though the responsibility for the assault lies solely with the perpetrator. If you are hesitant to speak out, know that your feelings are valid and shared by many other survivors.

The Consequences Are Long-Lasting

The impact of date rape extends far beyond the physical act. Survivors often contend with a range of devastating consequences, including physical injuries, sexually transmitted infections (STIs), and unwanted pregnancies.

The psychological trauma can be just as severe, leading to conditions like Post-Traumatic Stress Disorder (PTSD), anxiety, depression, and difficulties with future relationships.

Recovery can be financially costly, and some losses (such as pain and suffering or loss of enjoyment) can't be calculated in dollars and cents.

You Can File a Lawsuit Even if You Didn't Report the Date Rape

If you're a survivor of date rape and you chose not to report the assault to law enforcement, this does not prevent you from pursuing justice through a civil lawsuit.

In California, survivors can file a civil suit against their attacker to seek compensation for damages such as emotional distress, medical expenses, and lost wages. Civil cases have a lesser burden of proof than criminal cases, making it possible to hold your attacker accountable even without a police report.

What to Do If You Are a Victim of Date Rape

If you suspect you are a victim of sexual assault by someone you know, your immediate step should be to contact the police. It's essential to preserve any evidence for potential prosecution.
